Legislative, economic, and environmental constraints have led the French Government to impose energy consumption reduction obligations on both public and private organizations through the ELAN Law (Evolution of Housing, Spatial Planning and Digital Technology) of 23 November 2018.
Article 175 of this law requires a minimum reduction in energy consumption in tertiary-use buildings over 1,000 m² of 40% by 2030, 50% by 2040, and 60% by 2050, relative to a reference year chosen between 2010 and 2020.
To support the tertiary sector in its energy transition, the Government, in collaboration with ADEME, has developed the OPERAT platform. This platform aims to:
-Meet regulatory requirements for data collection,
-Verify achievement of the regulatory targets,
-Promote and disseminate the collected data while respecting confidentiality rules.
Once the historical data since 2010 has been collected and entered, organizations subject to the Tertiary Decree must report their annual energy consumption every year.
The initial reporting deadline, originally set for September 2021, was postponed to 30 September 2022 due to the Covid-19 health crisis. This date became the deadline for three mandatory submissions:
-Consumption data for 2020,
-Consumption data for 2021,
-Reference year data.
